A couple of other choice speeches by the same Stephen Ladyman, MP:

1. 9 August 2004: Speech by Stephen Ladyman MP, Parliamentary Under Secretary of State for Community: Better Living for Older People Conference
http://www.dh.gov.uk/en/News/Speeches/Speecheslist/DH_4088006

Quote: ‘Although I am calling my vision "a vision for social care" - I actually want it to be rooted in a much wider context - because people's lives are rooted in a much wider context.’

Quote: ‘I want to see a changed approach by social services. I want to see attitudes change from "can't do" to "can do". I want to see evidence of more "joined up" thinking with other parts of the council as well as with independent and voluntary sector organisations. I want to see better trained and more highly motivated care staff. I want to see active encouragement of direct payments. I want to see more support for family carers. I want to see more choice and control being given over to those who receive services both now and in the future.’

2. 24 November 2004: Speech by Stephen Ladyman MP, Parliamentary Under Secretary of State for Community: General Social Care Council conference speech
http://www.dh.gov.uk/en/News/Speeches/Speecheslist/DH_4096190
More evidence from recent history that things have not been as they should have been, and that they are still not as they should be:
2004: http://news.bbc.co.uk/1/hi/programmes/panorama/3900397.stm
Quote: ‘Last February the Health Ombudsman, Ann Abraham, investigated the issue of Continuing Care and presented the government with a warning.
She said: "A pattern is emerging of NHS bodies struggling and sometimes failing to conform to the law...resulting in actual or potential injustice arising to frail elderly people and their relatives. The indications are that problems may be widespread'.’

And this one says it all: (No, I haven’t read all 70 pages of it ... just skimmed and gleaned!!)
http://www.publications.parliament.uk/pa/cm200405/cmselect/cmhealth/399/399i.pdf

Quote: ‘Current arrangements for funding long term care are beset with complexity, and lack of clear Government guidance has led to widespread variations across the country. The artificial barriers between health and social care lie at the heart of the problems surrounding access to continuing care funding. It will be impossible to resolve these problems without first establishing a fully integrated health and social care system. We have therefore recommended, as this Committee and its predecessor Committees have done on numerous previous occasions, that the Government removes the structural division between health and social care.

And this one is from very very very recent history, dated 13 January 2010:

Quote: ‘Tom Clarke (Lab, Coatbridge, Chryston and Bellshill) expressed his concern that amendment 13 seeks to limit the discretion of local authorities in setting eligibility criteria for free care.

Fantastic Steve. Thanks for taking the time to put the links up for us all. Could you make a designated area on this board where all the links you and others have put here for us can go in together. I don't know if it could be done, maybe like the area at the bottom of this board where the drop down says 'general chat' , couldn't there be a drop down stating 'Links to useful information' and all the links could go there as I sometimes have trouble trying to find some of the ones I need to look at that have been previously posted.
Hope it can be done, as I'm a computer dunce I don't know how difficult this would be. Thanks

Direct payments - arranging your own care and services:
Direct payments are made by councils to people receiving social care services, instead of the council providing the service directly. Find out whether you can get direct payments, what you can and cannot use them for, and how to apply for them.

A simple and straightforward guide .... yes, I know it is all coming from a firm of Solicitors, but even so it's a fairly up-front explanation of the NHS Continuing Healthcare fiasco.

May be worth a read for beginners.

http://www.seniorsforumshropshire.org/PDF%20Wace%20Morgan/PDF%20Wace%20Morgan/Continuing%20Healthcare%20Funding%20AMENDED%20APRIL%202009-1.pdf

"The Welfare State intended that all sick people should be cared for in hospital, but in the 1980s there were massive closures of Cottage and Geriatric hospitals and long-stay wards. In the 1990s the Local Authorities/Social Services, through their social workers, were given the role of placing people in nursing homes and funding them, if necessary, after means testing. The principle of completely FREE nursing care of sick people, including the elderly, was largely forgotten."

Judicial Review of Community Care Decisions - Overview of the Case Law by Scott Blair

Goldsmith/Wandsworth

http://www.murraystable.com/files/articles/Judicial%20Review%20of%20Community%20Care%20Decisions.pdf

"There is no evidence that she took into consideration or communicated to [G’s daughter] any of the factors relating to the Appellant’s overall well-being as identified by [various documents], and – as her submission to the LCCP panel demonstrates – she was clearly concerned about the financial implications of the decision. In short, the decision of 13 August (if it was hers) was, in my judgment, a decision which was pre-determined, taken in the context of a manifestly flawed process and without a full and proper consideration of all the relevant considerations."

Anyone can make a referral to what used to be called POVA (Protection of Vulnerable Adults), or POCA in the case of children, if you feel that the person(s) who are responsible for the neglect/abuse should never be allowed to work again with vulnerable adults/children, and if you have already been let down by those who should have made the referral, often the local authority or the care provider!

IMCA involvement in accommodation decisions and care reviews

Post by Guest on Fri 17 Dec 2010 - 15:20

Local authorities and NHS trusts have the power of instructing an IMCA when they are undertaking reviews for individuals staying in accommodation arranged by a local authority or NHS trust, including care homes and hospitals.

The requirements are:

* the person lacks capacity to make a decision about their accommodation
* there are no family and friends who are appropriate to consult
* the person has been staying, or is likely to stay, in the accommodation for a continuous period of more than 12 weeks.

The information given out by this outfit is misleading and just plain WRONG and this thread has been deleted. Also this forum cannot be used to promote commercial interests and services.
For your information CRAG is irrelevant unless any accommodation provided by a local authority is proven to be provided within their mandate. Where there is illness, disability or injury ALL care including the provision of accommodation suitable for the delivery of that care is the sole responsibility of the NHS and no business of Social Services. A Local Authority CANNOT charge for services which they have no lawful mandate to provide in the first place. Steve.

Steve,

Counsel and Care is a much respected Charity. It also provides great support to carers.

It is nothing to do with 'commercial interest and services'.

It is a Charity, established in 1954 because of the poor levels of care experienced by many frail older people.
