Nothing to do with NHS FFCC but - still an important topic for those who are struggling to remain in their own homes and have been faced with cuts to the essential help they have been relying on to enable them to remain at home.

Hello Starlightblue

Really great news that and helped by a good firm of solicitors.

It is very pleasing because there has been two instances, one in Lancashire and one in Greater Manchester recently where two judicial reviews failed to prevent cuts to home care.

There was also the very important landmark case in Birmingham in May this year in which Birmingham council got defeated on this very same issue.

Interesting also two case in one week. Some more good news and it does reflect on CHC.

If the PCTs try to justify refusing to grant CHC because of cost thesed rulings can be useful.

Nice piece of researching that well done.

Good information. There was also the Supreme Court case a few months ago which sadly didn't go in favour for the retired former ballerina against a London Borough who reduced her visits and night care especially.

Not trying to be a "party pooper" - just believe we need all refs. to these developments so that we can see any trend as it develops.

The night care case was a bitter blow I thought and a dreadful and undignified injustice - not just for the lady concerned but for all those others who now have to have 24/7 care home care instead and who could otherwise perhaps have remained in their own homes.

Hello Starlightblue, A dreadful and undignified injustice is the practice in place in most care homes.....staff put on very large incontinent pads on patients in care homes at night...that is...even larger ones than the ones worn by the patient during the day. This case highlights good practice expected in accommodating all infirm elderly people by the SS...many in care homes are not incontinent if given assistance to walk to a toilet WHEN THEY NEED TO rather than, when the care staff occasionally have the time outside routine rushed visits!

Animals (much as I love them too) seem to have more protection and rights than do humans in their twilight years.
